2- Who is the controller of the personal data?

Cerbino Advocacia is the controller of your personal data in the scope of the relationship established with you. For the purposes of the applicable legislation, the controller is the person responsible for decisions regarding the processing of personal data.

3- What personal data is processed?

To the extent permitted by applicable law, Cerbino Advocacia may process the following personal data:

  1. Identification, qualification and contact details: full name, address, date of birth, nationality, details of identification document(s) (such as ID, CPF, CNH, OAB, as applicable), e-mail address and telephone number; and
  2. Academic and professional data: company you work for, profession, title, education;

In providing legal services across various areas of law, Cerbino Advocacia may have access to and process a wide range of your personal data or even the personal data of others involved in a given case (for example, the other party in a lawsuit), depending on the object or reason for the request. Examples of personal data processed by Cerbino ADVOCACIA include:

  1. Registration information: name, CPF, ID, address, and phone number.
  2. Financial information: remuneration, transaction history, credits, sales, possessions, debt certificates, loans.
  3. Family information: family structure and relationships.
  4. Information in legal cases: date of birth, nationality, naturalization, age, marital status, country, address, driver’s license, voter registration, military registration, profession, education, languages, professional registration, PIS/PASEP, work card (CTPS), NIS, NIT, CEI.

Cerbino Advocacia may collect this information in numerous ways. This personal data may be: (i) collected directly from the Data Subject; (ii) obtained from someone related to the Data Subject (for example, the company you are part of); or (iii) accessed from publicly accessible sources. 4- For what purposes do we process your personal data?

In general, we process your personal data for customer service and the provision of legal services, whether in an advisory or contentious capacity, including but not limited to:

  1. Drafting, reviewing or negotiating contracts;
  2. Conducting or participating in audits to verify a company’s compliance with Brazilian legislation and risk analysis;
  3. Managing investigations, inquiries, judicial, administrative, or arbitration proceedings, including analysis, drafting of documents, and monitoring the progress of such actions;
  4. Analyzing new products, structures, cases, or any situations presented by clients for preparing responses to consultations, memorandums, legal opinions, or expert reports;
  5. Drafting mandatory documents as required by Brazilian law;
  6. Mediating the client’s relationship with authorities and government agencies;
  7. Performing pro bono work;
  8. Conducting training sessions;
  9. Holding meetings, video conferences, or phone conferences for general discussions;
  10. Obtaining necessary licenses, authorizations, and permits;
  11. Assisting in participation in public tenders;
  12. Coordinating mergers, acquisitions, or capital market operations.

We may also process your personal data for the purposes of formalizing the contract with Cerbino Advocacia, billing and collection, if you are the natural person client or representative of a legal person client.

In addition, we may process your personal data in order to maintain our relationship with you through:

  1. Sending institutional communications, memorandums or newsletters on topics of interest and invitations to events;
  2. Organizing events, including managing registrants, sending invitations, reminders and acknowledgements. In order to guarantee your access to the event, Cerbino Advocacia may ask if you are disabled or have mobility restrictions;
  3. Conducting satisfaction and feedback surveys on our services and initiatives.

Occasionally, Cerbino Advocacia may provide your personal data so that national or international legal publications may contact you to evaluate and refer our services to such publications.

With whom do we share your personal data?

Cerbino Advocacia may share your personal data with:

  1. Software providers, cloud hosting services and other IT for the purposes of managing your relationship with our firm, registration, documentation and other measures;
  2. Correspondents, legal experts, partner firms (national and international), auditors, accountants, translators and financial institutions to assist in the provision of legal services, depending on demand and with prior authorization;
  3. Non-governmental organizations in the case of pro-bono work;
  4. National or international legal publications;
  5. Regulatory bodies and other authorities, such as the Brazilian Securities Commission (CVM), the Central Bank of Brazil (BCB), the Superintendence of Private Insurance (SUSEP), the National Data Protection Authority (ANPD), the National Telecommunications Agency (ANATEL), among others.

6- Transfer of your personal data outside of Brazil

Cerbino Advocacia may transfer your personal data to service providers located abroad, including cloud service providers. In addition, Cerbino Advocacia may share your personal data with partner firms.

When your personal data is transferred outside Brazil, Cerbino Advocacia will implement appropriate measures to ensure adequate protection of your personal data in accordance with the requirements of applicable data protection legislation, including by entering into appropriate data transfer agreements with third parties where necessary.

7- How long will we retain your personal data?

We store and maintain your information: (i) for as long as required by law; (ii) until the processing of personal data ends, as mentioned below; (iii) for as long as necessary to preserve the legitimate interest of Cerbino Advocacia, as the case may be; (iv) for as long as necessary to safeguard the regular exercise of Cerbino Advocacia’s rights in judicial, administrative or arbitration proceedings.

Thus, we will process your data, for example, during the applicable deadlines or for as long as necessary to comply with a legal or regulatory obligation. The processing of personal data will cease in the following cases:
